A Code of Practice has been developed by the Transport Industry Council and provides the transport industry with examples and information regarding unconscionable conduct involving owner drivers.The new Code was proclaimed as Regulations to the new Act on 24 October 2006, and provide the Victorian Civil and Administrative Tribunal with guidance in determining whether conduct has been engaged in which justifies the use of remedies provided for under the Act.
The memorandum describes who the Code apply to, what the Code does, what the mandatory requirements of the Code are, and provides guidance on unjust contract terms, unconscionable conduct, industry best practice and dispute resolution.
